Compliance Reviews

Before your firm or your client becomes engaged in defending a costly private action suit or government investigation, you can take proactive action. I will conduct a thorough compliance review in an effort to anticipate compliance issues.  I will educate your staff or client and provide solutions to avoid future liabilities due to costly labor violations.

Usually, the solutions are fairly simple and may entail a clearer record keeping system or a different way to present payments already being made.  I will also inform you of the numerous exemptions available in the FLSA and how they might apply to your firm or your client's firm.

Common areas of non-compliance that we can examine are as follows:

1}·      Minimum wage and proper application of the tipped credit

2}·      Tip Pooling issues

3}·      Exemptions (Executive, Administrative, Professional; retail/service commission exemption, Motor Carrier Act Exemption; etc.)

4}·    Overtime and regular rate issues

5}·      Hours of work issues

6}·      Non-compensable work time; meals, travel time, sleep time

7}·      Family Medical Leave Act

8}·      Prevailing Wage Rate issues

9}·    Independent Contractor issues

10}·   NY State Labor Law
